As a general rule, a great many of us work very hard and long to acquire and keep property during our lifetime, In spite of such efforts, it is surprising that so many of us die without leaving a will. In other words, during our lifetime, we worry about accumulating wealth, but for inexplicable reasons, may overlook how this property will be distributed upon our death! The end result of this lack of concern is that those who die without a will end up forfeiting or giving up their right to determine the disposition of their property and, more importantly, may fail to provide for the well being of their immediate family members. Departing this life without leaving behind a Will means one is risking the possibility of leaving the security of one's family to chance and the disposition of one's property to the whim and preferences of the state legislature. Hence whatever law happens to be in force at the time of one's death, in the absence of a Will, will control or decide what, who, or how one's property is to be distributed at the time of one's death.
Some of the consequences of this default may be unintended by the deceased. Consider a few past examples of what can take place in the case of a small estate: 1) The surviving spouse may not receive an adequate amount of the decedent's estate, and ; 2) If any of the children are minors, and both parents pass away at the same time, guardianships (which can be expensive) may need to be established. This situation can become far more problematic when the decedent passes on having been married a second time leaving behind a spouse, an ex-spouse and children from both the first and second marriages. The surviving spouse may end up sharing ownership of their home with the adult children of the decedent's former marriage! Even when the decedent passes away having left behind them a properly drawn Will that was likewise kept in a place where it can be easily found, it may turn out to have little value to the beneficiaries if not kept up to date! Matters such as parenthood, grandparenthood, divorce, changing needs of beneficiaries, sale or other disposal of property mentioned in the will, unavailability (death, senility, incapacity) of an executor or trustee, gifts, newly acquired assets, and an increase or decrease in the size of an estate are all reasons why the Will needs to be reviewed from time to time.
